Elon Musk sued over 'illegal lottery' by Philadelphia DA over $1,000,000 daily 'prize'

Musk was previously warned that he could be in violation with federal election law

Elon Musk is being sued over his ‘illegal lottery’ by the Philadelphia DA for the $1 million daily ‘prize’.

The tech mogul shocked people by announcing that he would give away the huge sum to one lucky person each day in the lead up to the election.

However, in order to be in with a chance of winning the life changing amount, you’d first need to sign a petition.

The petition is said to promote ‘free speech and the right to bear arms’ and the billionaire has been selecting one random person each day to award them with the cash ‘prize’.

On Saturday, October 19, Musk stuck to his word, handing over the first check to a man in Pennsylvania.

He was previously warned by the US Department of Justice that his daily giveaways could be in violation with federal election law.

Now, the Philadelphia DA has filed a lawsuit in a bid to stop the Tesla boss’s political action committee from handing out money to registered voters in swing states.

The lawsuit states: “America PAC and Elon Musk are running an illegal lottery in Philadelphia (as well as throughout Pennsylvania).”

In the claim, it is specified that at the rally on October 19, Musk said any registered voter would be eligible to win the money if they handed over personal information and signed the petition to pledge ‘support for the constitution’.

The lawsuit continues: “That is a lottery, and it is indisputably an unlawful lottery.”

It also states that all lotteries in Pennsylvania must be regulated by the state according to state law.

District attorney, Larry Krasner, said in a statement: “The Philadelphia District Attorney is charged with protecting the public from public nuisances and unfair trade practices, including illegal lotteries.

“The DA is also charged with protecting the public from interference with the integrity of elections.”

Pennsylvania is one of the key swing states in the election and some experts have said that it’s the most important one for the presidential candidates to win.

Musk has been very vocal about his support of Donald Trump, even attending one of Trump’s political rallies and appearing onstage with the Republican candidate.

Addressing the crowd at the rally, Musk said: “America is the home of the brave and the true test of someone’s character is how they behave under fire.

“We had one president who couldn’t climb a flight of stairs and another who was fist-pumping after getting shot! Fight, fight, fight!”

He added: “I’m being repetitive for a reason. Honestly you want to be a pest. Fight, fight, fight! Vote, vote, vote!”

Trump praised Musk for donating Starlink systems to victims impacted by Hurricane Helene before adding: “I didn’t know what the hell Starlink was.”
